Stocks end mixed, Dow again can't top 13,000

Stocks rallied back from early session losses Monday to end mixed. The Dow Jones industrial average again traded above 13,000, but again failed end the day above that level.

According to preliminary calculations, the Dow finished down 1.44, or 0.01 percent, to 12,981.51. The S&P 500 rose 1.86, or 0.14 percent, to 1,367.60. The Nasdaq ended 2.41 higher, or 0.08 percent, to 2,966.16.

Two bits of economic news may have helped the market.? A poll of the National Association of Business Economists found its members more confident about the recovery and January pending home sales hit a two-year high.

The Dow broke through 13,000 several times last week but hasn't closed above that level since May 19, 2008. On Friday, the S&P closed at its highest level since June 2008.

Scott Wren, senior equity strategist for Wells Fargo Advisors in St. Louis, said investors have gotten ahead of themselves since October. The S&P 500 is up 8.7 percent this year alone.

(AP) ? The mayor and police director of New Jersey's largest city said Wednesday the New York Police Department misled their city and never told them it was conducting a widespread spying operation on Newark's Muslim neighborhoods. Had they known, they said, they never would have allowed it.

"If anyone in my police department had known this was a blanket investigation of individuals based on nothing but their religion, that strikes at the core of our beliefs and my beliefs very personally, and it would have merited a far sterner response," Newark Mayor Cory Booker said.

In mid-2007, the NYPD's secretive Demographics Unit fanned out across Newark, photographing every mosque and eavesdropping in Muslim businesses. The findings were cataloged in a 60-page report, obtained by The Associated Press, that served as a police guidebook to Newark's Muslims. There was no mention of terrorism or any criminal wrongdoing.

Officials reacted strongly on Wednesday.

"It is deeply offensive for me to do blanket surveillance for no reason other than religious affiliation," said Booker, who called on his state's attorney general to investigate.

Newark Police Director Samuel DeMaio, who was deputy chief of the department at the time, said the NYPD asked to be shown around the city. New York police said it was part of an investigation but never revealed what it was about, DeMaio said.

"We really want to be clear: This type of activity is not what the Newark PD would ever do," he said.

New Jersey Gov. Chris Christie, who was the top federal prosecutor in the state in 2007, said he didn't remember the NYPD ever approaching him about surveillance in the city or a threat that would justify it. He called the Newark report "disturbing."

"The NYPD has at times developed a reputation of asking forgiveness rather than permission," he said.

Such surveillance has become common in New York City in the decade since the Sept. 11, 2001, attacks. Nearly 3,000 Americans died when al-Qaida terrorists hijacked airliners and flew them into the World Trade Center in New York, the Pentagon near Washington and a field where one crashed in Pennsylvania.

Police have built databases showing where Muslims live, where they buy groceries, what Internet cafes they use and where they watch sports. Dozens of mosques and student groups have been infiltrated, and police have built detailed profiles of local ethnic groups, from Moroccans to Egyptians to Albanians.

But the NYPD's intelligence unit also operates far outside its jurisdiction and has worked to keep tabs on Muslims across the Northeast. The department has cataloged Muslim communities in Long Island, conducted undercover operations in New Brunswick, N.J., and has turned often innocuous Internet postings by Muslim student groups into police files.

The monitoring of Muslim college students across the Northeast drew sharp rebukes from administrators at Yale, Columbia and elsewhere earlier this week. But New York Mayor Michael Bloomberg issued his most vigorous defense of his police department to date.

"The police department goes where there are allegations. And they look to see whether those allegations are true," he told reporters Tuesday. "That's what you'd expect them to do. That's what you'd want them to do. Remind yourself when you turn out the light tonight."

NYPD spokesman Paul Browne did not respond to a message seeking comment on the Newark effort Wednesday. He has previously denied the existence of the Demographics Unit.

The documents obtained by the AP show, for the first time in any detail, how the NYPD's intelligence-gathering efforts stretched outside the department's jurisdiction. New Jersey and Long Island residents had no reason to suspect the NYPD was watching them. And the department is not accountable to their votes or tax dollars.

NYPD conducted similar operations in Suffolk and Nassau counties on suburban Long Island, according to police records. The NYPD frequently operates outside its jurisdiction without telling federal or local officials.

The report left Newark Muslims grasping for explanations as they saw pictures of their mosques and businesses in police files.

"All of these are innocent people," Nagiba el-Sioufi of Newark said recently while her husband, Mohammed, flipped through the NYPD report.

Egyptian immigrants and American citizens, the couple raised two daughters in the United States. Mohammed works as an accountant and is vice president of the Islamic Culture Center, a mosque a few blocks from Newark City Hall.

"If you have an accusation on us, then spend the money on doing this to us," Nagiba said. "But you have no accusation."

The Newark police director at the time, Garry McCarthy, is now in charge of the Chicago Police Department. He said the NYPD initiated the operation and none of his officers participated.

The goal of the report, like others the Demographics Unit compiled, was to give police at-their-fingertips access to information about Muslim neighborhoods. If police got a tip about an Egyptian terrorist in the area, for instance, they wanted to immediately know where he was likely to find a cheap room to rent, where he might buy his lunch and at what mosque he might attend Friday prayers.

"These locations provide the maximum ability to assess the general opinions and general activity of these communities," the NYPD Newark report said.

The effect of the program was that hundreds of American citizens were cataloged ? sometimes by name, sometimes simply by their businesses and their ethnicity ? in secret police files that spanned hundreds of pages:

? "A Black Muslim male named Mussa was working in the rear of store," an NYPD detective wrote after a clandestine visit to a dollar store in Shirley, N.Y., on Long Island.

? "The manager of this restaurant is an Indian Muslim male named Vicky Amin" was the report back from an Indian restaurant in Lindenhurst, N.Y., also on Long Island.

? "Owned and operated by an African Muslim (possibly Sudanese) male named Abdullah Ddita," was the summary from another dollar store in Shirley, N.Y., just off the highway on the way to the Hamptons, the wealthy Long Island getaway.

In one report, an officer describes how he put people at ease by speaking in Punjabi and Urdu, languages commonly spoken in Pakistan.

There are no allegations of terrorism in the Demographics Unit reports, and the documents make clear that police were interested only in locations frequented by Muslims. The canvass of businesses in Newark mentions Islam and Muslims 27 times. In one section of the report, police wrote that the largest immigrant groups in Newark were from Portugal and Brazil. But they did not photograph businesses or churches for those groups.

"No Muslim component within these communities was identified," police wrote, except for one business owned by a Brazilian Muslim of Palestinian descent.

Polls show that most New Yorkers strongly support the NYPD's counterterrorism efforts and don't believe police unfairly target Muslims. Civil rights groups and Muslim activists, however, have called for Police Commissioner Ray Kelly's resignation over the spying and the department's screening of a video that portrays Muslims as wanting to dominate the United States.

In Newark, the report was met with a mixture of confusion and anger.

"Come, look at yourself on film," Abdul Kareem Abdullah called to his wife as he flipped through the NYPD files at the lunch counter of their restaurant, Hamidah's Cafe.

An American-born citizen who converted to Islam decades ago, Abdullah said he understands why, after the 9/11 terror attacks, people are afraid of Muslims. But he said he wishes the police would stop by, say hello, meet him and his customers and get to know them. The documents show police have no interest in that, he said.

"They just want to keep tabs on us," he said. "If they really wanted to understand, they'd come talk to us."

Newark Mayor Booker met with Islamic leaders while campaigning for his post. Those interviewed by the AP said they wanted to believe he didn't authorize the spying but wanted to hear from him directly.

"I have to look in his eyes," Mohammed el-Sioufi said at his mosque. "I know him. I met him. He was here."

Because officers conducted the operation covertly, the reports contain mistakes that could have been corrected had the officers talked to store owners or imams. If police ever had to rely on the database during an unfolding terrorism emergency as they had planned, those errors would have hindered their efforts.

For instance, locals said several businesses identified as belonging to African-American Muslims actually were owned by Afghans or Pakistanis. El-Sioufi's mosque is listed as an African-American mosque, but he said the imam is from Egypt and the congregation is a roughly even mix of black converts and people of foreign ancestries.

"We're not trying to hide anything. We are out in the open," said Abdul A. Muhammad, the imam of the Masjid Ali Muslim mosque in Newark. "You want to come in? We have an open door policy."

By choosing instead to conduct such widespread surveillance, Mohammed el-Sioufi said, police send the message that the whole community is suspect.

"When you spy on someone, you are kind of accusing them. You are not accepting them for choosing Islam," Nagiba el-Sioufi said. "This doesn't say, 'This guy did something wrong.' This says, 'Everyone here is a Muslim.'"

"It makes you feel uncomfortable, like this is not your country," she added. "This is our country."

WASHINGTON (AP) ? First birth control, now prenatal testing? Once again a fact of life for many American women has become a jarring issue in the presidential race.

Republican candidate Rick Santorum is making free screenings for birth defects part of his attack on President Barack Obama's health care law. Santorum, who has a young daughter with a serious genetic disorder, said rules requiring insurers to cover prenatal tests are designed to encourage more women to have abortions that will "cull the ranks of the disabled in our society."

Obama re-election campaign spokeswoman Lis Smith called Santorum's remarks "misinformed and dangerous." She said the tests are for the health of mothers and babies and help bring about safer deliveries.

Federal health officials and the nation's obstetricians recommend that all pregnant women be offered blood tests and an ultrasound exam that assess the risk of having a baby with various birth defects or genetic disorders, including Down syndrome. If the screening raises concern, a woman may choose further testing, such as amniocentesis.

How did these commonplace tests spark so much controversy?

?Some women don't want the tests because they know they wouldn't abort their fetus no matter what the results. Others who wouldn't consider an abortion still want the tests ? seeking reassurance that all is well or, if not, the chance to adjust emotionally and prepare for a disabled baby's more complicated care. Babies with Down syndrome can need specialized attention at delivery that affects hospital selection.

?Some women avoid amniocentesis, which involves withdrawing amniotic fluid through a needle, because of the small chance it could cause a miscarriage. There are less invasive tests available, however, and newer ones on the way.

?As Santorum noted, studies show that in the vast majority of cases where amniocentesis reveals Down syndrome, women decide on abortion.

?Advocates for the disabled, including many parents of Down syndrome children, worry that couples are choosing abortion without considering that their child could lead a happy, fulfilling life. About one in 800 babies is born with Down syndrome, a condition in which having an extra chromosome causes mental retardation, a characteristic broad, flat face and, often, serious heart defects.

The prenatal testing issues have been debated by abortion foes and obstetricians and wrestled with by prospective parents. But the ethical quandaries and painful emotional decisions received scant public attention before the politically charged remarks from Santorum, who also opposes the government requiring birth control coverage for employees of religiously affiliated organizations.

Until now, perhaps the best-known personal reflections on the prenatal testing decision came from two well-known conservatives, each the parent of a Down syndrome child. They saw the issue differently:

?"I was grateful to have all those months to prepare. I can't imagine the moms that are surprised at the end. I think they have it a lot harder," Sarah Palin, the 2008 Republican vice presidential nominee, said about the amniocentesis results she received before her son Trig was born.

?"What is antiseptically called 'screening' for Down syndrome is, much more often than not, a search-and-destroy mission: At least 85 percent of pregnancies in which Down syndrome is diagnosed are ended by abortions," columnist George Will wrote in a 2007 column about his grown son Jon and the recommendation by the American College of Obstetricians and Gynecologists that all pregnant women be screened.

Santorum, whose daughter Bella has a different genetic disorder, Trisomy 18, said in a CBS interview on Sunday: "Almost 100 percent of Trisomy 18 children are encouraged to be aborted, so I know what I'm talking about here."

Restaurant Review ? Wahaca ? White City

Wahaca is a smallish restaurant chain at the moment 6 sites around London plus a street kitchen, it was started by Thomasina Miers and her Husband, I hope you will all remember Thomasina as she won the BBC cookery competition Masterchef in 2005 (Which I think was the only time I watched a complete series).

We decided to start do early as we has two children with us, who had been on the go all day, so just after 6 we arrived, the place was not full but was still busy, after a few moment we where show to our table and our waitress explained the options and then while we decided she brought us some nibbles.

We has the Fresh Tomato salsa, Guacamole, which my wife raved about, she is a but of an expert on eating Guacamole if left unwatched, and Frijoles which is a dip made with twice cooked black beans that has to be tried to be believed, it is served with a topping of finely grated cheese, all of these came with tortilla chips.

On the table we has a couple of Chilli Sauces which we have now got in our schedule for review, so more about them later.

We decided we would try all the street foods, it recommend we order 2-3 dishes each, so we has the lot:-

  • MSC Herring ? Smoke Herrings with Tomato Salsa and Lime Juice
  • Chicken Guajillo ? Chicken , Lettuce, Guacamolewith Smokey Guajilli Oil
  • Black Bean ? Refried beans, with Avacado Salsa, Cheese and Tomato Salsa

Taquitos- Corn tortillas?wrapped?around:-

  • Marinated Chicken ? Lettuce, Cheese and Tomato Salsa
  • Savoy and Pasilla ? Savoy Cabbage, Mushrooms, Pasilla Salsa with Lettuce, Feta and Chipotle Salsa.

Quesadillas ? Large toasted tortillas folded over a filling of:-

  • Black Beans & Cheese
  • Chorizo & Potato
  • Chipotle Chicken
  • Huitlacoche ? Mushrooms, corn, and melted cheese

There is no special?children?s?menu, but our waitress arranged some dishes to come without any spicy?accompaniments, but most of the food was not overly spicy and while our five year old (Mary) did not eat a lot she liked the tortilla chips and Antony (11) loved it all

And then there was the puddings, but after so much we almost passed on this, but the ?Churros Y Chocolate? was so tempting we order 3, two with Chocolate and one with Caramel sauce. As you can see Antony was very taken with these.

With drinks for 4 adults and 2 children the bill came to about ?150, but we did not so short measures on anything and the street food ranged from ?3.50 to ?4.50 per plate.

This?restaurant?is not for the intimate romantic meal the place is noisy with little in the way of soft furnishing to?deaden the sounds, if you closed you eyes you could be in a noisy street market. I?understand?that each?of the other in the chain has it own?individual?ambience.

On the way out (and in) there was a large bowl full of what looked like ?match books, but turned out to be promotional packs of seedsticks?make by a?company?called Sow Easy , each?contains?5 seedsticks with Serrano chilli seeds ready to plant and grown your own Mexican?experience.

Over the weekend we visited a number of?restaurants, some that included a service charge in the bill, but provided very little service, wahaca was not one of these we had a great time and we would like to thank Ed Rebelo and all the staff at wahaca for a great meal, we will be back to try more very soon.

McCain says Egypt working to resolve NGO crisis

(AP) ? Sen. John McCain said Monday Egypt's military rulers have reassured him that authorities are working "diligently" to resolve a criminal case against U.S. pro-democracy groups that has brought relations between the two allies to their lowest point in decades.

It was the first public statement to indicate the two sides are trying to find a way to move from the brink of a spat that has threatened U.S. aid to Egypt and shook confidence in the country's transition to democracy.

As part of a crackdown on nonprofit organizations, Egyptian authorities have referred 16 Americans and 27 others to trial on charges that include the illegal use of foreign funds, which is expected to begin on Feb. 26. McCain chairs one of the four American groups targeted.

He had met earlier in Cairo with the country's military ruler Field Marshal Hussein Tantawi.

"He gave us his assurance that they are working very diligently to try to resolve the NGO issue," McCain told reporters after a day of conferences with Egyptian officials, newly elected lawmakers, and members of the country's powerful Islamist group, the Muslim Brotherhood.

It is not clear how the issue can be resolved. McCain said it is up to the administration and the Egypt government to work out this "very important and delicate" matter.

"We are confident that people of good faith in this country and our country and many others can and will find an acceptable resolution to the present situation," McCain said.

McCain, who is leading a Congressional delegation visiting various countries in the Middle East as well as Afghanistan, has tried to send reassuring message about the importance of relations between Egypt and Washington.

McCain said threats to cut U.S. aid to Egypt, that now includes an annual $1.3 billion to the military and about $250 million in economic aid, may be counterproductive.

U.S. officials and legislators have threatened to cut Egypt's $1.5 billion package over the crackdown on the democracy groups. The case began in December with raids on the groups' Egypt offices, and Egyptian judges and officials subsequently accused them of using foreign funds to foment unrest in the country through supporting political activities and protests.

"The way we approach this issue of NGOs is with some guarded optimism that we will resolve this issue fairly soon," he said. "We don't think it helps progress, on this very difficult situation for American citizens, to make threats (to cut aid). We are not making threats. There is plenty of time to make threats," said McCain.

Egyptian officials were mute on the subject Monday. The state official news agency only said Tantawi discussed changes in U.S.-Egypt relations with McCain's delegation, as well as the nature of activities of civil society groups in Egypt in light of the democratic transition.

Egypt under Mubarak was Washington's closest Arab ally in the Middle East and a loyal partner in the fight against Islamic extremism and terror. Mubarak also kept the 1979 peace treaty with Israel, a cornerstone of U.S. foreign policy in the Mideast.

But with the military on the defensive over criticism that it has bungled the transition to democracy and with the rise of an Islamist-dominated parliament, Egypt's transitional rulers appeared to be more ready to publicly challenge the U.S. and Israel, even at the risk of losing critical foreign aid. That stance taps into widespread anti-Israel and anti-U.S. sentiment in Egypt.

The ruling Supreme Council of the Armed Forces has regularly accused "foreign hands" of backing continued protests against its rule. And the Islamist parties that control over two-thirds of the newly elected parliament have threatened to review the peace treaty with Israel if U.S. aid to Egypt is halted.

Visiting Sen. Lindsey Graham, R-S.C., said the accusations against the organizations were "ridiculous" and laid the blame on a single "politically motivated" figure.

Graham, who is on the board of the International Republican Institute, didn't name the person in question. But nonprofit members have previously told Congress that Faiza Aboul Naga, a Mubarak holder who heads the ministry in charge of nonprofit organization affairs, was to blame.

"This was a politically motivated action. The person who brought this forward I think has an agenda that is not helpful, and as an American I am offended that people would say things about these organizations," Graham said. "I am hopeful this gets behind us. The people we talked to understand that they want it to be behind us also."

At the same time, Graham tried to fend off much of the criticism directed against Egypt's military.

"What is at stake here? the Egyptian military has its problems. But the reason we are not talking about Egypt in the same breath as Syria is because of the military. This relationship between the US military and the Egyptian military has been invaluable," Graham said.

Graham also said that Brotherhood members reassured the visiting delegation that they are committed to changing a restrictive law governing civil groups operating in Egypt, which the senators said was a sign that the new dominant force in Egypt's parliament is committed to democratic reform.

Student hacks into Facebook, gets eight months in prison, twelve likes

On Friday, British Student Glenn Mangham was sentenced to eight months in not-so-social jail, for hacking deep into Facebook's servers. Apparently no user details were taken, with Mangham heading straight for "invaluable" intellectual property instead. Facebook alerted the authorities after it discovered the breach last May, the FBI then followed the digital thread back to the Briton's UK address. It's believed Mangham gained access to the inner sanctum after hacking into a Facebook employee's account, though it's not known if the comedy status update and embarrassing profile picture were also part of the attack.
